Data processing is based on the statutory provisions of § 96 (3) TKG and Art. 6 (1) (a ) or (f) (legitimate interest) of the GDPR.

Our concern in the sense of the GDPR (legitimate interest) is the improvement of our offer and our website. Since the privacy of our users is important to us, the user data is pseudonymised.

The user data is stored for a period of 14 months.

Due to the interest in analysis and optimisation, the so-called "Facebook pixel" of the social network Facebook (Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) is used within our online offer. The code implemented on this page can evaluate the behaviour of visitors. With the help of the Facebook pixel, Facebook is able to determine the visitors of our offer as a target group for the display of ads, so-called "Facebook ads". The collected data cannot be viewed by us, but can only be used in the context of advertisements.

Online presence in the social media

We are present on social platforms Facebook, LinkedIn and YouTube in order to be able to communicate with users who are also active there and inform them about our services. The terms and conditions and data processing guidelines of the respective platform operators apply exclusively when the respective platform is called up.

Facebook Contests

All contests are in no way connected to Facebook. All entrants accept our privacy policy and terms and conditions by participating. Eligible to participate in the sweepstakes are all persons who have reached the age of 18 and are resident in Austria. Employees of the entire HIRSCH Servo AG and affiliated companies are excluded. Participation with forged identities or identities of third parties is not permitted. The winners will be randomly selected from all eligible participants within one week of the closing date and notified via Facebook Messenger. Only 1 prize per participant is possible. The participant guarantees to be the owner of the necessary rights to the uploaded or linked photos. If the participant is not the sole author or holder of the rights, he expressly declares that he has the necessary rights to participate in the competition. The participant grants us the following simple, temporally and spatially unlimited but non-exclusive rights of use to the photo used by him. If the participant uploads photos, the participant guarantees that he will not send any content whose provision, publication or use violates applicable law or the rights of third parties. The participant indemnifies us against any claims of third parties whatsoever resulting from the illegality of photos used by the participant. The obligation to indemnify also includes the obligation to completely indemnify the organizer from legal defense costs (e.g. court and attorney fees). By participating in the competition, the participant releases Facebook from any liability. We reserve the right to terminate the competition in whole or in part prematurely at any time, even without adhering to deadlines, or to modify it in its course, if it is not possible for technical (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons (e.g. prohibition by Facebook) to guarantee a proper execution of the competition. We are responsible for the collection, processing and use of personal data of the participants, provided that we process these ourselves. We will only use the participant's personal details and other personal data within the framework of the statutory provisions of data protection law. We will store, process and use the information only to the extent necessary for the execution of the competition or with the consent of the participant. This also includes use to exercise the rights of use granted. The data will be used exclusively for the execution of the raffle and then deleted. Austrian law applies. A legal way to the examination of the draw is impossible.
